1. Acceptance of Terms

By accessing or using ClearPen ("the Service"), operated at clearpen.ai, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

ClearPen is an AI-powered writing refinement tool that helps users improve the natural quality of their text. The Service includes text humanization and AI detection scoring features. ClearPen is a writing improvement tool — it does not generate original content, write assignments, or produce academic work on your behalf.

3. User Responsibilities

• You are solely responsible for how you use the output from ClearPen.
• You must comply with your school, employer, or organization's policies regarding AI-assisted writing tools.
• You must not misrepresent AI-generated work as entirely your own where prohibited by applicable policies.
• You are responsible for properly citing sources and maintaining academic integrity.
• You must not use the Service for any unlawful purpose or to generate harmful, abusive, or fraudulent content.

4. No Guarantees

ClearPen does not guarantee that processed text will achieve any specific score on any AI detection tool. AI detection technology evolves continuously, and results may vary. The Service is provided "as is" without warranties of any kind.

5. Accounts and Billing

• You must provide accurate information when creating an account.
• Paid subscriptions are billed in advance on a monthly or annual basis through Stripe.
• You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.
• Refunds are available within 7 days of initial purchase for paid plans if you are not satisfied.
• We reserve the right to change pricing with 30 days' notice to existing subscribers.

6. Usage Limits

Each plan includes a monthly word allocation. Unused words do not roll over between billing periods. We reserve the right to suspend accounts that abuse the Service or attempt to circumvent usage limits.

7. Intellectual Property

You retain ownership of all text you submit to and receive from the Service. ClearPen does not claim ownership of your content. We may use anonymized, aggregated usage data to improve the Service.

8. Data Processing

Text submitted to ClearPen is processed through third-party AI services (Anthropic Claude, GPTZero) to provide humanization and detection features. By using the Service, you consent to this processing. See our Privacy Policy for details.

9. Limitation of Liability

To the maximum extent permitted by law, ClearPen shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of academic standing, employment consequences, or reputational harm arising from your use of the Service.

10. Termination

We may terminate or suspend your account at any time for violation of these terms. Upon termination, your right to use the Service ceases immediately.

11. Changes to Terms

We may update these terms from time to time. Continued use of the Service after changes constitutes acceptance of the new terms.
