1. Acceptance of Terms

By accessing or using ClearPen ("the Service"), operated at clearpen.ai by PKDM Services OÜ, a company registered in Estonia (registry number 17198549), with its registered address at Juhkentali 8, 10132 Tallinn, Estonia ("we", "us", "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not access or use the Service. We may update these Terms from time to time, and your continued use of the Service after any changes constitutes acceptance of the updated Terms.

2. Description of Service

ClearPen is an AI-powered text refinement service that helps users improve the natural quality of their writing. The Service includes:

• Text humanization — AI-assisted rewriting that restructures sentence patterns, varies rhythm, and adjusts tone to make text sound more naturally written.
• AI detection scoring — analysis of text to estimate the likelihood that it would be flagged by AI detection tools.

ClearPen is a writing refinement tool. It does not generate original content, write assignments, produce academic work, or create text from scratch on your behalf.

3. Account Terms

To use the Service, you must create an account through our authentication provider, Clerk. You agree to:

• Provide accurate, current, and complete information during registration.
• Maintain the security of your account credentials and not share your login with others.
• Maintain only one account per person. Creating multiple accounts to circumvent usage limits or exploit free trials is prohibited.
• Notify us immediately of any unauthorized access to your account.

You are responsible for all activity that occurs under your account.

4. Acceptable Use Policy

You agree not to use the Service to:

• Process, generate, or distribute content that is illegal, harmful, threatening, abusive, harassing, defamatory, obscene, or otherwise objectionable.
• Commit academic fraud or plagiarism. ClearPen is designed to refine writing quality, not to help users misrepresent the authorship of their work in violation of institutional policies.
• Circumvent, disable, or interfere with the Service's security features, usage limits, or rate limiting mechanisms.
• Use automated scripts, bots, or other means to access the Service beyond normal human use.
• Reverse engineer, decompile, or attempt to extract the source code or algorithms of the Service.
• Resell, redistribute, or sublicense access to the Service without our written permission.

You are solely responsible for how you use the output from ClearPen and must comply with your school, employer, or organization's policies regarding AI-assisted writing tools.

5. Subscription and Billing

ClearPen offers paid subscription plans billed through Stripe.

• Billing cycles: Subscriptions are available on monthly or annual billing cycles. Annual plans are billed upfront for the full year.
• Auto-renewal: Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date.
• Price changes:We reserve the right to change pricing with at least 30 days' notice to existing subscribers. Price changes take effect at the start of your next billing period.
• Refunds: You may request a full refund within 7 days of your initial paid subscription purchase. After this period, no partial refunds are issued for unused time within a billing period.
• Failed payments: If a payment fails, we may suspend your access to paid features until the payment issue is resolved.

6. Usage Limits

Each subscription plan includes a monthly word allocation and a per-request word limit. These limits are as follows:

• Starter: 30,000 words/month, 1,000 words per request.
• Pro: 80,000 words/month, 1,500 words per request.
• Power: 250,000 words/month, 2,500 words per request.

Unused words do not roll over between billing periods. We reserve the right to apply rate limiting to prevent abuse and ensure fair access for all users. Accounts that attempt to circumvent usage limits may be suspended or terminated.

7. Intellectual Property

• Your content: You retain full ownership of all text you submit to and receive from the Service. ClearPen does not claim any ownership rights over your input or output content.
• Our service: The Service, including its design, code, algorithms, branding, and documentation, is owned by ClearPen and protected by intellectual property laws. These Terms do not grant you any rights to our intellectual property beyond the right to use the Service as intended.
• Aggregated data: We may use anonymized, aggregated usage data (not your actual text content) to improve the Service and for analytics purposes.

8. Disclaimers and No Guarantees

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied.

• ClearPen does not guarantee that processed text will achieve any specific score on any AI detection tool, including but not limited to Turnitin, GPTZero, Originality.ai, or any other detection service.
• AI detection technology evolves continuously. Results may vary based on text length, subject matter, language, and changes to third-party detection algorithms.
• We do not guarantee uninterrupted or error-free service. The Service may be temporarily unavailable due to maintenance, updates, or factors beyond our control.

9. Limitation of Liability

To the maximum extent permitted by applicable law, ClearPen and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of academic standing or grades
• Employment consequences or lost business opportunities
• Reputational harm
• Loss of data or profits

arising from your use of or inability to use the Service, even if we have been advised of the possibility of such damages. Our total cumulative liability for all claims related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Termination

• By you: You may cancel your subscription and stop using the Service at any time. Cancellation takes effect at the end of the current billing period.
• By us: We may suspend or terminate your account at any time, with or without notice, if we reasonably believe you have violated these Terms, engaged in abusive behavior, or used the Service in a manner that could harm other users or the Service itself.
• Upon termination, your right to use the Service ceases immediately. We may delete your account data in accordance with our Privacy Policy.

11. Third-Party Services

The Service relies on third-party providers to function. By using ClearPen, you acknowledge that your text is processed through:

• Anthropic (Claude API) — for AI-powered text humanization
• GPTZero — for AI detection scoring
• Clerk — for authentication and user management
• Stripe — for payment processing

Each provider operates under their own terms of service and privacy policies. We are not responsible for the practices or availability of these third-party services.

12. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Service shall be resolved in the state or federal courts located in Delaware.

13. Changes to These Terms

We may update these Terms from time to time. We will notify users of material changes via email or an in-app notification at least 30 days before changes take effect. Continued use of the Service after changes constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
